Terms and Conditions For Tenerife Guided Walks

These terms and conditions along with the confirmation by email of your booking comprise your agreement with Tenerife Guided Walks. Tenerife Guided Walks (the company) is a trading style for Andrew John Tomkins (I) otherwise known as Andy Tenerife Walker. Registered with the Tenerife Tourism Board “Intermediación Turística, identification number I-0003474.1. Senderismo NR-38-4-0000330.
1. General Conditions

1. Your obligations:
  •   1.1 You must be reasonably fit and well to fulfil the requirements of the walk. If you have any physical or health problems that may affect you or any other person on the walk, then you are obliged to tell me about this due to the mountainous conditions of the terrain, altitude, heat, extreme weather conditions on occasions, and the ascent/descent on certain walks. I reserve the right to cancel or change a walk should it be clearly apparent that you are not physically capable of completing the tour or if your condition would affect the other hikers in the group. 
  •  1.2 You must have suitable holiday insurance cover including emergency call out, as whilst I have Public Liability Insurance, it does not cover an accident or an emergency call out should medical assistance be required. Should an accident occur and/or if medical treatment should be needed, this is totally your responsibility and your liability. 
  • 1.3 You agree to behave in a seemly fashion and in a manner that does not threaten the condition or safety of yourself or any other hikers in the group. 
  • 1.4 You agree to follow the instructions given by me, your guide, at all times. 
  • 1.5 You must have suitable clothing, footwear and food and drink. Walking boots and poles are not necessary (except for Mount Guajara and the Teide Trek), however, good walking shoes or trainers with a solid grip are a must. You also need suntan cream and a hat. You should also be prepared for changeable weather conditions which can happen at any time, therefore, a weatherproof and warm clothing may be required on some occasions. Please also bring a snack for lunch time and adequate water. 
  • 1.6 You agree to follow the rules and regulations of nature protection especially within the National Park and other designated areas. Strict regulations and penalties are in place for every case of non-compliance. Designated hiking paths are in place and must be adhered to. It is not permitted in this area to pick plants, collect stones or any other natural or living object/thing within the National Park and other designated protected areas. 

2. Teide Trek – Special Conditions

Special conditions apply to this trek due to the hardness of the climb and weather conditions:
  •   2.1 Payment is required in full at the point of booking and is non-refundable.
  •  2.2 Booking needs to be well in advance as I need to apply for the permits and book the overnight accommodation at the Refuge Altavista (El Refugio Altavista). Permits are subject to availability as they only issue a maximum of 200 per day. Your full name and Passport number are required for this.
  •  2.3 This Trek is occasionally affected by extreme weather conditions especially in Winter. The route and the Refuge is governed by the Council and in severe weather conditions the route and the Refuge may be closed. Should this be the case, these matters are out of my control. I will, however, offer alternative walks should this be the case. 
  • 2.4 You must have suitable hiking boots, poles, warm clothing, gloves, head torch and sufficient food and drink provisions for 2 days. High energy foods such as nuts and chocolate are recommended. The refuge has a small kitchen and a microwave so foods such as packet Pasta dishes are ideal for dinner. Remember though – whatever you bring, you have to carry. 
  • 2.5 Children must be a minimum of 8 years of age. 

3. Limitations and Liability
  • 3.1 Tenerife Guided Walks is not responsible for any losses or damages incurred. 
  • 3.2 Tenerife Guided Walks is not responsible for any defects or problems arisen from any third parties, eg. mini-bus company services, taxis, water taxis etc. 
  • 3.3 Tenerife Guided Walks reserves the right to change a walk even if last minute if necessary should the weather conditions be adverse or should I decide that the path or trail is dangerous. In these circumstances, I will always offer an alternative choice of walk that is safe and/or where the weather conditions will be more conducive for walking providing this is physically possible
3.4 Tenerife Guided Walks reserves the right to terminate a walk should:
  •  I deem that you are not physically well enough or capable of completing the walk 
  •  The weather conditions are extreme and/or dangerous 
  • A path or trail suddenly becomes dangerous or impassable 
  • A rock fall occurs 
4.  Amendments and cancellation of your booking(s)
  • 4.1 If you wish to change your booking, I will do my very best to accommodate you, but I cannot guarantee that I will be able to do so. 
  • 4.2 If you wish to cancel your booking, you must let me know at least 30 days prior to the booking. Please note that any payments made in advance will not be refunded if less than 30 days’ notice is given. Should this be the case, you will need to claim the money from your holiday insurance. 
  •  4.3 No refunds will be made at all for Teide Trek bookings, please see clause 4.1 below. 
  • 4.4 Should I have to change your booking for example in the case of extreme weather conditions, I will let you know as soon as possible. I will make every effort to provide you with a similar walk. 
  • 4.5 Compensation payments or refund payments will not be made where a cancellation is caused by situations under “Force Majeure”, such as warfare, riots, civil unrest, terrorist activity, industrial disputes, natural disasters, fire or similar events outside of my control. 
5. Booking and Confirmation
  • 5.1 Upon booking, you will be sent a confirmation by email. 
  • 5.2 By placing a booking you agree that you have read and agree to be bound by these Terms and Conditions. 
6. Fees and payment
  •   6.1 Deposits are not normally required unless your booking is more than 6 months in advance. 
  •  6.2 In these circumstances monies paid are non-refundable in accordance with clause 4.2 above. 
  • 6.3 The Teide Trek must be paid for in full at the point of booking and this is non-refundable in any circumstances, please see clause 2.1 above.
  •  6.4 Payments can be made by either PayPal or Bank Transfer. 
  • 6.5 All prices are subject to IGIC (local tax) at 7%.
7. Variation to these Terms and Conditions
  • 7.1 No variation to these Terms and Conditions shall be valid unless given in writing or by email. 
8. Data Protection
  • Tenerife Guided Walks does not pass any personal information to any third parties, except to the Tenerife Government (Gobierno de Canarias) for the permit and accommodation on the Teide 2 Day Trek which is obligatory

9. Governing Law and Jurisdiction
  • These Terms and Conditions are governed by the Law of Granadilla de Abona.
